1.⁠ ⁠About Us

NearMeTrades Ltd ("NearMeTrades", "we", "us", "our") operates the website https://www.nearmetrades.co.uk and any associated mobile or web applications (together, the "Platform").  NearMeTrades Ltd is a company registered in England and Wales with company number 14812412 and registered office at 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ.

2.⁠ ⁠Interpretation

Customer – a person or business using the Platform to search for, contact or review independent tradespeople.
Tradesperson – an individual or business listed on the Platform offering their services to Customers.
User, you, your – any person who accesses or uses the Platform, whether as a Customer or Tradesperson.

3.⁠ ⁠Acceptance of These Terms

By accessing or using the Platform you confirm that you:
1.⁠ ⁠are at least 18 years old; and
2.⁠ ⁠accept and agree to be bound by these Terms, our Privacy Policy, Cookie Policy and Acceptable Use Policy (together, the "Policies"). If you do not agree to these Terms or any of the Policies you must not use the Platform.

4.⁠ ⁠Our Service

4.1 NearMeTrades is an online introductory platform.  We provide tools that allow Customers to locate, contact and review Tradespeople who list their services on the Platform.

4.2 We do not supply or deliver trade services ourselves, and we are not a party to any contract entered into between a Customer and a Tradesperson.  Any such contract is solely between those parties.

4.3 We engage independent verification partners (the "Vetting Partners") who perform vetting checks on Tradespeople and may offer their own guarantees in respect of those checks. Any questions, claims or disputes concerning those guarantees must be directed to the relevant Vetting Partner and not to NearMeTrades. Users must still undertake their own checks and obtain any professional advice they consider necessary before entering into an agreement.

5.⁠ ⁠Your Account & Information

You may need to create an account to access certain functionality.  Each user may register one account only.
You must keep your login credentials secure and not share them with anyone else.
All information you provide must be accurate and kept up‑to‑date.  We will process personal data in accordance with our Privacy Policy.

6.⁠ ⁠Permitted Use

You may use the Platform only for lawful purposes.  You must not:
breach any applicable local, national or international law or regulation;
post, upload or transmit material that is defamatory, obscene, hateful, discriminatory or otherwise unlawful;
knowingly introduce viruses, Trojans, worms or other material that is malicious or technologically harmful;
harvest data or scrape the Platform without our express permission;
interfere with, damage or disrupt any part of the Platform, equipment or network on which it is stored; or
attempt to gain unauthorised access to any part of the Platform or related systems.

7.⁠ ⁠User Contributions (Reviews, Comments, Media)

7.1 Any reviews, ratings, comments, photographs, videos or other content you submit ("Contributions") must be:
accurate where stating facts;
genuinely held where stating opinions; and
compliant with UK law.

7.2 Contributions must not:
contain defamatory, obscene, offensive or hateful material;
promote violence, discrimination or illegal activity;
infringe copyright, trademark or other intellectual property rights of any person; or
impersonate any person or misrepresent your identity or affiliation.

7.3 You grant NearMeTrades a perpetual, worldwide, royalty‑free, transferable licence to use, reproduce, distribute, prepare derivative works of and display your Contributions in connection with operating and promoting the Platform.

8.⁠ ⁠Intellectual Property

8.1 All intellectual property rights in the Platform and its content (excluding User Contributions) belong to NearMeTrades or its licensors. All rights are reserved.

8.2 You may print or download extracts of content for your personal use only and must not modify any material you have copied or downloaded.

8.3 You must not use any part of the content on the Platform for commercial purposes without obtaining a licence from us or our licensors.

9.⁠ ⁠Linking

You may link to the home page of the Site in a way that is fair, legal and does not damage our reputation or take advantage of it. You must not:
suggest any form of association, approval or endorsement on our part where none exists;
establish a link to the Site in any website not owned by you; or
frame the Site on any other site. We reserve the right to withdraw linking permission without notice.

10.⁠ ⁠Disclaimers & Limitation of Liability

10.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under English law.

10.2 Subject to clause 10.1, we shall not be liable for:
loss of profits, revenue or business;
loss of anticipated savings;
loss of goodwill or reputation;
loss of data; or
any indirect, special or consequential loss or damage.

10.3 We shall not be liable for any loss or damage arising from:
use of, or inability to use, the Platform;
reliance on any content displayed on the Platform; or
any contract or arrangement between a Customer and a Tradesperson.

10.4 The Platform is provided "as is" without warranty of any kind, whether express or implied.  We do not warrant that the Platform will be uninterrupted or error‑free, or that any content will be accurate, complete or up to date.

11.⁠ ⁠Suspension & Termination

We may suspend or terminate your account and/or access to the Platform immediately and without liability if you breach these Terms or any applicable law, or if we are required to do so for security or legal reasons.

12.⁠ ⁠Events Outside Our Control

We will not be liable for any delay or failure in performance caused by events outside our reasonable control, including (without limitation) acts of God, strikes, lock‑outs, epidemics, failures of telecommunications or utilities, or natural disasters.

13.⁠ ⁠Changes to the Platform or These Terms

We may update the Platform and/or these Terms from time to time.  Material changes will be posted on this page and, where appropriate, notified to you by email.  Continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms.

14.⁠ ⁠Governing Law & Jurisdiction

These Terms, their subject matter and formation (and any non‑contractual disputes or claims) are governed by the laws of England and Wales.  You and we agree to the exclusive jurisdiction of the courts of England and Wales.
